Meta and TikTok Prevail in EU Court Over Tech Supervision Fees

On Wednesday, September 10, 2025, Meta Platforms and TikTok secured a legal victory against a supervisory levy imposed by the European Union under its landmark Digital Services Act (DSA). Europe’s second-highest court ruled that EU regulators erred in the way they calculated the fee, handing a win to the tech giants.

The dispute arose after the European Commission charged Meta and TikTok a supervisory fee amounting to 0.05% of their global annual net income. The fee was intended to offset the Commission’s costs in monitoring compliance with the DSA.
Challenging the legality of the levy, Meta and ByteDance-owned TikTok argued that the method used to determine the fee was flawed. The court’s decision sided with the companies, finding fault in the Commission’s calculation process.
This ruling not only relieves the two platforms from paying the contested charge but also casts broader doubt on the EU’s approach to funding oversight of major online platforms.
